Your agent's data

What your personal agent keeps, where it lives, who can read it, how long it stays, and how to take it with you or delete it. We ask you to read this before we set your agent up.

1. What this page covers

This page is about the agent that Ilinskii Ilia PR Novi Sad, trading as Const. ("we"), builds and runs for you once you are a client. The request you send from this site is covered by the Privacy notice.

You decide what goes into your agent and what it does. We run it for you and use what it holds only to provide the service to you. We never use it to train models, to build profiles, for advertising, or for anyone else's purposes.

2. What your agent keeps

  • Your conversations with it: the messages, photos, documents and voice messages you send, the text of each voice message, and its replies.
  • Its memory: notes about you, the people you mention and your plans, a note for each day, and the knowledge pages it builds from them, so it can find things again.
  • What it makes for you: reports, research, summaries, reminders and the routines you set up.
  • What you connect: data from services you choose to connect, such as your calendar, and only from those.
  • Settings: your name, language, time zone, quiet hours, and the Telegram account that is allowed to talk to it.
  • Technical records: short error reports the agent writes when something fails, which can quote the request that failed; checks of its replies that store their length and a fingerprint, not their text; and the service's own logs.

Health and other people

If you share health information, such as sleep, meals, training or test results, the agent keeps it like everything else, to help you organise it and remind you. It does not give medical advice.

If you tell the agent about other people, such as family members, colleagues or helpers, it keeps what you tell it the same way. Share about others only what you would write in a private notebook.

3. Where it lives

  • On a server we rent from DigitalOcean in Amsterdam, the Netherlands. Your agent's data sits on an encrypted disk volume (LUKS2, AES).
  • Every client has a separate system account, separate isolated containers and separate backups with their own password. Agents of different clients cannot see each other.
  • Backups: the last seven daily archives on the same encrypted volume, and encrypted copies in DigitalOcean's storage in Frankfurt, Germany.
  • Search across the agent's memory runs on the same server with a local model. It does not leave the server.

4. Who else processes it

  • OpenAI provides the model. To answer you, the agent sends OpenAI the conversation, including what it reads from your files. When it works through a Const. API key, OpenAI does not use that data to train models by default and may keep it for up to 30 days to detect abuse; audio sent for transcription is not kept (OpenAI data controls). If you choose to connect your own ChatGPT subscription instead, OpenAI processes the requests under your account's terms and data controls, including the setting that decides whether content may be used to improve models (in ChatGPT settings, under Data controls).
  • ElevenLabs transcribes your voice messages when your agent uses it for speech recognition. The audio goes to ElevenLabs and is kept under its policy. In our ElevenLabs account the use of data for training models is switched off (ElevenLabs privacy policy).
  • Telegram carries your messages. Chats with a bot are stored on Telegram's servers and are not end to end encrypted (Telegram privacy policy).
  • Search engines see the words of a web search, but not who asked: the agent searches through our own search service on the server. Websites the agent opens for you see our server's address, not yours.
  • DigitalOcean hosts the server and the encrypted backups.

There is nothing else: no analytics, no advertising, no other AI services. Any new service, for example one you ask us to connect, is added only after you agree to it.

OpenAI, ElevenLabs and DigitalOcean are companies established in the United States, and Telegram operates internationally. They may process data outside the EU under the safeguards in their terms, including the European Commission's standard contractual clauses.

5. Who at Const. can read it

We would rather say this plainly: the people who operate the service have administrator access to the server, so they can technically read everything on it. The same is true of any hosted service. What matters is what we actually look at.

  • Every day we get a short summary: which onboarding steps are done, the wishes and connection requests you ask the agent to pass to us, how many failures there were, whether the agent restarted, the results of its health checks and how fresh its backups are. The agent tells you when something goes to our team. The summary never contains the text of your conversations.
  • When something breaks, we read the error report to fix it, so a report may show us a fragment of the request that failed.
  • The text of your conversations we open only with your permission, for a specific problem, and only as much as that problem needs.

Access is limited to the people who operate the service, under NDA.

6. How long it is kept

  • While you are a client: for as long as the service runs, unless you ask us to delete something sooner.
  • Backups: local archives for 7 days. Encrypted copies for up to 12 months: daily ones for 14 days, weekly ones for 8 weeks and monthly ones for 12 months.
  • When you leave: within 30 days after the service ends we delete the agent, its data, the local archives and every backup copy. Your client number and Telegram account ID may remain in backups of the server's own configuration for up to 12 months.

7. Taking it with you and deleting it

  • Export: at any time, and always before we delete anything when you leave, we give you a full archive of your agent on request. If you want, you also get its backup copies together with their password.
  • Deleting something: ask the agent to forget it, or write to us. Backups are taken as whole copies, so an item deleted from the agent stays in the existing encrypted copies until they expire. If it has to disappear from them as well, tell us and we delete the older copies.
  • Deleting everything: write to us, and we delete it all as described above, without waiting for the end of the paid period.

8. On what basis

  • Running your agent is what our agreement with you is for. Legal basis: performance of a contract, Article 6(1)(b) GDPR.
  • Health information is kept on the basis of your explicit consent, Article 9(2)(a) GDPR, which you give by agreeing to this page. You can withdraw it at any time by asking us to delete that information.
  • Error reports and service logs exist so the service keeps working. Legal basis: our legitimate interest, Article 6(1)(f).

9. Your rights

You can ask us for a copy of your data, to correct it, to delete it, to restrict what we do with it, to hand it over in a portable form, or object to our use of it. You can withdraw your consent at any time, which does not affect what we did before.

Write to ilia@oshn-ai.com. We reply within 30 days. There is no fee.

If you are not satisfied, you can complain to the Commissioner for Information of Public Importance and Personal Data Protection in Serbia, or, if you are in the EU or EEA, to the supervisory authority where you live.

10. Security

Data sits on an encrypted volume. Each client's agent runs under its own system account, and its working container has no direct internet access: it reaches the web only through tools the service controls. Passwords and keys are kept outside the agent's configuration, the server accepts administrator logins only with a personal key, and failures alert us. We do not claim any system is beyond compromise, and if a breach ever affects your data we will tell you and the relevant authority as the law requires.

11. Changes

If this page changes, we update the date and the version at the top and tell you before the new version applies to your agent. The version you agreed to is recorded with your agent's setup.
